49. In Tennessee if you are not married to the father you cannot have his name on the birth certificate unless he is there to sign it. Other wise a woman could put any mans name on the certificate.

My sister had a daughter and did not give her the fathers last name. (he is a douche bag and my niece thankfully does not have to see him). If you are not with the father and the child is going to spend most of the time with the mother there is nothing wrong with giving them your last name.
